释义 | 並行利益 A benefit additional to, or supplementary to, a principal benefit. In an action for damages, a collateral benefit may be awarded to the plaintiff depending on the relevant circumstances which may include statutory considerations. Traditionally, the establishment of such a benefit was founded on the existence of a prior contractual relationship between the parties, or an implied contract between them. However, the courts have adopted the view that the conferring of such a benefit will depend on the circumstances of the particular case, the relationship between the parties and whether or not there is a debt or obligation owed by one party to another by law, apart from any consent or intention of the parties or any privity of contract: Professional Associates v Polytek Engineering Co Ltd [1986] HKLR 20 (HC).
