| 释义 | 自動履約 1.Termination of a contract on the breach of a clause of the contract that purports to be self-executing: Westralian Formers Ltd v Commonwealth Agricultural Service Engineers Ltd [1936] 54 CLR 361. The words making the clause self-executing must be very clear. Otherwise, the court will find that the contract is not automatically discharged on breach but that the innocent party must elect to terminate: Suttor v Gundowda Pty Ltd [1950] 81 CLR 418. 2. The discharge of a person from bankruptcy: Bankruptcy Ordinance (Cap 6) s 30A. In the absence of a valid objection, a bankrupt would be discharged from bankruptcy by the expiration of the relevant period after the commencement of bankruptcy, that is, the day when the bankruptcy order was made. The relevant period is four years for a person who has not previously been adjudged bankrupt. A trustee in bankruptcy or a creditor can file an objection to the discharge not less than 14 days before the expiry of the relevant period. If the Court is satisfied that the objection is valid, an order may be made to suspend the running of the relevant period for a period not exceeding four years for a person not previously been adjudged bankrupt or not exceeding three years for a person who has previously been adjudged bankrupt.
