释义 | 原告無權起訴之抗辯 A plea by an accused person to the effect that the prosecution of the offence charged cannot proceed because it offends the common law rule against double jeopardy. Generally, the term relates to the pleas of autrefois acquit or autrefois convict. However, a form of the plea can be raised in either summary or indictable proceedings and is a plea analogous to a plea of autrefois convict or autrefois acquit where such a plea is not technically open to the accused because of the limited nature of those pleas. If the plea is successfully raised, the charge cannot continue to be prosecuted: Criminal Procedure Ordinance (Cap 221) s 31; Hong Kong Bill of Rights Ordinance (Cap 383) art 11(6).
