Depending on the circumstances, factors relevant to a plea in mitigation may include: the age of the offender (A-G v Chan Tak King [1989] 2 HKLR 428, [1989] 1 HKC 48); time spent in custody other than that ordered by a judge in Hong Kong (A-G v Mao Ky-khoang [1994] 2 HKCLR 166, [1994] 3 HKC 688 (CA)); substantial assistance to the authorities in the investigation or prosecution of the offences which must be substantial assistance as opposed to promised or intended assistance (R v Chiu Pak Wing [1995] 2 HKC 819 (CA)); or hardship to the offender like extreme ill-health or suffering (R v Chan Kui Sheung [1996] 3 HKC 279 (CA)). Actions may sometimes constitute a plea in mitigation even if this is not expressly stated: Kam Wai Hung v S-J (CACV 264/2002, unreported).
