A person who supplies goods to consumers in the course of business, not for the purpose of re-supply; a natural person who is engaged in a retail business in Hong Kong (Hong Kong Tourism Board Ordinance (Cap 302) s 2). Retailers are liable to consumers who suffer loss or damage as a result of such things as: the retailer’s breach of an express or implied warranty; goods which are not fit for the purpose for which they were purchased; goods which are of unmerchantable quality; goods which do not correspond with a description or sample; and goods which do not have adequate repair facilities or spare parts. The duty of care in relation to goods supplied extends to retailers who have to perform some work on the goods other than mere distribution (Herschtal v Stewart and Ardern Ltd [1940] 1 KB 155, [1939] 4 All ER 123), including those checks which a retailer of the goods in question would reasonably be expected to make (Fisher v Harrods Ltd [1966] 1 Lloyd’s Rep 500).
