1. Prohibition of transfer of an interest in property by sale or otherwise. Conditions in restraint of alienation in dispositions of property are generally void: Re Dugdale (1888) 38 Ch D 176. 2. A condition contained in a lease restricting the alienation of land which is the subject of the lease by the lessee and his successors and assigns whether by way of an agreement, an assignment, a lease, a mortgage or otherwise, prior to the compliance with the conditions of the lease, except with the Director of Land’s written consent and in accordance with the lease: Government Rent (Assessment and Collection) Regulation (Cap 515A) s 1. For example, a condition in the Government lease restraining the Government lessee from disposing of the land until the premium has been paid, and the Certificate of Compliance has issued: Halsbury’s Laws of Hong Kong, Vol 16, 2001 Reissue, Land [230.0113].
