释义 | 行事權力 The express or implied power of a legal practitioner as agent of the client to bind the client in dealings with third parties. A legal practitioner retained to act in contentious work has implied authority to bind the client in a wide range of matters including the compromise or settlement of the action: Little v Spreadbury [1910] 2 KB 658. The scope of a legal practitioner’s implied power to bind the client in non-contentious work is more limited. A legal practitioner who commences or defends court proceedings warrants his or her authority to do so: Myers v Elman [1939] 4 All ER 484, [1940] AC 282 (HL). Where costs are wasted as a result of a solicitor commencing or defending proceedings without authority the court may order the solicitor to pay those costs: Yonge v Toynbee [1910] 1 KB 215 (CA); Re Raja Enterprises Ltd [1978] HKLR 249 (HC).
