May not be allowed as evidence. Evidence will be inadmissible where it is not relevant to a fact in issue in a proceeding. Hearsay evidence is generally inadmissible. Privileged evidence, for example confidential communications between a client and his legal adviser, may not be admitted: Wheeler v Le Marchant (1881) 17 Ch D 675 (CA); Bullivant v A-G for Victoria [1901] AC 196 (HL). Certain evidence may also be declared inadmissible in the court’s discretion: R v Sang [1980] AC 402 (HL). The oral testimony of a witness is inadmissible at common law unless the witness has been sworn to speak the truth: Lord Shaftsbury v Lord Digby (1676) 89 ER 314; R v Marsham, ex p Penthick Lawrence [1912] 2 KB 362 (DC).
