释义 | 煽惑 The act of persuading or encouraging another to commit an act which would constitute a crime if done by that other: R v Curr [1967] 1 All ER 478, 51 Cr App Rep 113, [1968] 2 QB 944 (CA). Incitement is a common law offence: R v Higgins (1801) 2 East 5. The offence is committed even if the crime is not carried out or attempted: R v Higgins, supra. For an incitement to be complete, there must be some form of actual communication with the person whom it is intended to incite: R v Cope (1921) 16 Cr App Rep 77 (CA). It is a statutory offence for a person to incite others to act in a disorderly manner at any public gathering for the purpose of preventing the transaction of the business for which the public gathering was called together: Public Order Ordinance (Cap 245) s 17B. Incitement may occur as a result of threats or pressure as well as by persuasion and may be express or implied: R v Lee Chiu Yan (HCMA 672/93, unreported). A person can be guilty of incitement of a person, to incite a further person, to commit a crime provided the further person, in fact exists: R v Kong Yue Kwai [1996] 4 HKC 709 (CA). It is also incitement to incite another to conspire to pervert the course of justice: Mak Sun Kwong v R [1980] HKC 88, HKLR 466 (CA).
