释义 | 代價不足 Consideration which is not commensurate in value to the promise which it supports. As a general rule, given that merely nominal consideration may amount to sufficient consideration, courts do not concern themselves with the adequacy of consideration (Gaumont-British Picture Corp Ltd v Alexander [1936] 2 All ER 1686), but the adequacy of consideration may be relevant to issues of economic duress, mistake, fraud (Cole v Milsome [1951] 1 All ER 311), undue influence or unconscionability. No Purchase, made bona fide and without fraud, of any interest in property of any kind with Hong Kong is liable to be opened or set aside merely on the ground of undervalue: Conveyancing and Property Ordinance (Cap 219) s 59. However, court’s jurisdiction to set aside or modify unconscionable bargains remains unaffected: Permanent Trustee Co of New South Wales Ltd v Bridgewater [1936] 3 All ER 501 (PC).
