To point out by the court the differences between the present case and a decided case, and to argue that the rule in the decided case does not apply to the present case although there is an apparent similarity. When a previous case can be distinguished, the court would not be bound to follow the previous case in deciding the present case. It is because even though there are apparent similarities between the previous case and the present one, the principles of law and the fundamental or material facts of the two cases may not be the same.
