释义 | 誤稱 1. The incorrect name of a person in an accusation, indictment, or pleading. If the mistake was made in good faith, was genuine and not misleading and raised no reasonable doubt as to the true identity of the proposed party and it would be just to make the amendment, the court will readily grant leave to correct the wrong name of the party or to substitute the name of the right party even after the expiry of the limitation period: The Rules of the High Court (Cap 4A) O 20 r 5(3) . Note that a correction can only be made to correct the mistake of the name of a party but not a mistake as to the identity: International Bulk Shipping and Services Ltd v Minerals and Metals Trading Corp of India [1996] 1 All ER 1017. An amendment to correct a misnomer may be allowed after a final default judgment: Singh v Atombrook Ltd [1989] 1 All ER 385. 2. Inaccurate description of a person, place or tenement, in a document required for the purposes of the Rating Ordinance, nor any mistake, informality or omission committed in any proceedings: Rating Ordinance (Cap 116) s 51(1). Any misnomer shall invalidate or prejudice the document or proceeding or in any way affect the operation of the Ordinance: s 51(1).
