释义 | 獎券活動 A contest where the outcome is mainly determined through the operation of chance, the disposition of prizes by lot: Taylor v Smetten (1883) 11 QBD 207 (DC). It includes a raffle, a sweepstake, tse fa, hung piu, po piu, any competition for money or other property success in which involves guessing or estimating the results of future events, or of past events the results of which are not generally known; or does not depend to a substantial degree upon the exercise of skill by the competitors; and any game, method, device or scheme for distributing or allotting prizes by lot or chance, whether promoted, conducted or managed in or outside Hong Kong: Gambling Ordinance (Cap 148) s 2. A contest where the primary determinant is skill is called a competition: Imperial Tobacco Ltd & Anor v A-G [1980] 1 All ER 866, [1981] AC 718 (HL). There must be some actual contribution made by the participants in return for obtaining a chance to take part in the lottery: Reader’s Digest Assn Ltd v Williams [1976] 3 All ER 737, 1 WLR 1109 (DC). The concept of a lottery is that of a multipartite arrangement under which a pool or fund is created and then distributed or alloted to persons selected either by chance or according to the outcome of some sporting events, but not that type of gambling which consisted a bilateral wagering agreement under which there was a reciprocal risk of loss: A-G v Chan Wah [1946-1972] HKC 684 (HC). Lotteries are unlawful unless they are authorised by the government under statutory law or a licence granted under the Gambling Ordinance: Gambling Ordinance (Cap 148) s 4. Lawful lottery is held by the Government Lotteries Management Committee under the Government Lotteries Ordinance (Cap 334). The Hong Kong Jockey Club also holds lottery under the Betting Duty Ordinance (Cap 108).
