释义 | 遺失的遺囑 Where a will is lost or missing on the death of the testator and was last known to be in the testator’s possession, a rebuttable presumption is made that the testator destroyed the will with the intention of revoking it: Re Riordan (dec’d) [1961] VR 271. Probate may be granted of an unrevoked missing will on proof of its due execution and attestation and on sufficient evidence of its contents and terms: Leung Kwai Lin Cindy v Wu Wing Kuen [2001] 1 HKC 567.
