| 释义 | 區域法院法官 A judge of the District Court, who is appointed by the Chief Executive on the recommendation of the Judicial Officers Recommendation Commission: Basic Law art 88; District Court Ordinance (Cap 336) s 4(2); Judicial Officers Recommendation Commission Ordinance (Cap 92) s 2, sch 1. No person may be appointed to be a district judge unless he is qualified to practise as an advocate or as a solicitor in a court in Hong Kong or any other common law jurisdiction having unlimited jurisdiction either in civil or in criminal matters: District Court Ordinance (Cap 336) s 5(1)(a). And since becoming so qualified he has for a period of or periods totalling not less than five years practised as an advocate or solicitor in such court; or been a permanent magistrate; or been a legal officer; or been a Director, Deputy Director, Assistant Director of Legal Aid or Legal Aid Officer; or been an Official Receiver, Assistant Official Receiver (Legal), Assistant Principal Solicitor, Senior Solicitor or Solicitor; or been a Director, Deputy Director or Assistant Director of Intellectual Property or a Senior Solicitor: s 5(1)(b)(i)–(x). See also District Court. 區域法院法官須由行政長官按照司法人員推薦委員會的建議委任：《基本法》第88條； 《區域法院條例》（第336章）第 4(2)條；《司法人員推薦委員會條例》（第92章）第2條及附表1。除非有關人士在香港或任何其他普通法適用地區的任何法院有資格執業為出庭代訟人或律師，而該法院是在民事或刑事方面具有無限司法管轄權的，否則任何人不得獲委任為區域法院法官：《區域法院條例》（第336章）第5(1)(a)條。自具有如此的資格後，該人已在一段不少於5年的期間或在不同期間而合共不少於5年的期間，是在該等法院之一執業為出庭代訟人或律師；或常任裁判官；或律政人員；或法律援助署署長、副署長、助理署長或法律援助主任；或破產管理署署長、助理破產管理署署長(法律)、助理首席律師、高級律師或律師；或知識產權署署長、副署長或助理署長或高級律師：第 5(1)(b)(i)至(x)條。另見 District Court。 |
