释义 | 沒有合理的希望被定罪 The test applied by the director of public prosecutions to determine whether there is sufficient evidence to justify a prosecution, on the basis that the prosecution should not proceed if there is no reasonable prospect of a conviction even though there may be a prima facie case. If it is demonstrated that there is no reasonable prospect of a conviction after a new trial, one would not be ordered: R v Holgate (No 2) [1996] 3 HKC 324 (CA).
