| 释义 | 顯著性 The capacity of a trade mark to distinguish the goods or services of the trade mark proprietor from the other. A trade mark is registrable in the register if it is inherently adapted to distinguish the goods or services of the trade mark proprietor from the goods or services of the others: Trade Marks Ordinance (Cap 559) s 5(9)(1)(e). A trade mark is registable in the register if it is any sign which is capable of distinguishing the goods or services of one undertaking from those of other undertakings and which is capable of being represented graphically: Trade Marks Ordinance (Cap 559) s 3. In determining the distinctiveness of the mark for registration, the extent of the inherent distinctiveness of the mark and any factual distinctiveness through use or through any other circumstances are taken into consideration.
