| 释义 | 婚姻有效聲明 An authoritative and binding statement of a court pronouncing the validity of a marriage. A person, if he or she is domiciled in Hong Kong or claims any real or personal estate situated in Hong Kong, may apply to the court for a decree declaring that the marriage of his parents, or his grandparents was a valid marriage or that his own marriage was a valid marriage: Matrimonial Causes Ordinance (Cap 179) s 49(1). Although there is a general power under The Rules of the High Court (Cap 4A) O 15 r 16 for the courts to make declarations of right, this power is to be used sparingly. See also Decree; Decree nisi; Void marriage. 宣布某婚姻有效的既官方又有約束力的法院聲明。任何人如是以香港為居籍或聲稱在香港擁有任何土地產業或非土地產業，可以呈請方式向法院申請判令，宣布其父母、祖父母或外祖父母的婚姻是有效的婚姻，或宣布其本人的婚姻是有效的婚姻：《婚姻訴訟條例》 （第179章）第49條(1)。儘管根據高等法院規則（第4A章）第15號命令第16條規則，法院有一般作出關於權利的宣佈，但須審慎地使用此權力。另見 Decree; Decree nisi; Void marriage。 |
