| 释义 | 欺騙手段 Misleading by deliberate misrepresentation. Any deception (whether deliberate or reckless) by words or conduct as to fact or as to law, including a deception relating to the past, the present or the future and a deception as to the intentions or opinions of the person using the deception or any other person.: Theft Ordinance (Cap 210) s 17(4); Gambling Ordinance (Cap 148) s 16(1). It is an offence if a person obtains property belonging to other, pecuniary advantage, services, with an intention of permanently depriving the other of it, or evades liability by deception for himself or others, whether or not such deception was the sole or main inducement: Theft Ordinance (Cap 210) ss 17-18A; Independent Commission Against Corruption Ordinance (Cap 204) ss 15-18. No person shall directly or indirectly, in a transaction involving securities, futures contracts or leveraged foreign exchange trading, (a) employ any device, scheme or artifice with intent to defraud or deceive; or (b) engage in any act, practice or course of business which is fraudulent or deceptive, or would operate as a fraud or deception: Securities and Futures Ordinance (Cap 571) s 300(1).
