| 释义 | 擾亂秩序的行為 Behaviour which causes disturbance or annoyance to others present or any substantial breach of decorum which tends to disturb the peace or interfere with the comfort of other people. It is an offence to behave in a disorderly manner which was intended to cause a breach of peace: Public Order Ordinance (Cap 245) s 17B; Road Traffic (Public Service Vehicles) Regulations (Cap 374D) reg 46. Likelihood of injury to a person or damage to property is required: R v Kam Man Fai (HCMA 930/83, unreported); HKSAR v Chan Wing Hung [1997] 3 HKC 472 (CA); HKSAR v Yang You Ching [1997] 3 HKC 744; HKSAR v Tsui Yat Hung & Ors [1999] 3 HKC 47. It would be impossible for the prosecution to give particulars of disorderly conduct in a case involving multiple defendants: HKSAR v Wong Ying Yu & Ors [1997] 3 HKC 452.
