释义 | 刑罰的不一致 An appreciable difference between the penalty given to a particular offender and the usual penalty for the offence of which he or she has been convicted. The test is whether a right thinking members of the public to conclude that the sentences were so disparate that there was something wrong with them: R v Fawcett (1983) 5 Cr App R (S) 158; R v Ng Wah Kan (CACC 475/87, unreported).
