释义 | 無理的纏擾 Trouble or distress caused by annoyance, irritation, dissatisfaction, or disappointment. Damages for vexation are recoverable where the trouble or distress results from physical inconvenience caused by the breach of a contract (Watts v Morrow [1991] 4 All ER 937, 1 WLR 1421 (CA)), or the contract provides for enjoyment, relaxation, or freedom from vexation, such as a contract to provide a holiday (Hardwick v Spence Robinson [1973–1976] HKC 241 (HC)). Where vexation is a reasonably foreseeable consequence of a defendant’s negligence, damages may be recoverable in respect of it: Heywood v Wellers (A Firm) [1976] QB 446, 1 All ER 300 (CA).
