1. Property that has not yet come into existence, and that will be owned by a person once in existence, such as property to be made. 2. Property in existence but owned by another, that a person expects to receive in future, i.e. property to be inherited: for example Dall v Choy Ying Wai (No 2) [1999] 1 HKC 544, 1 HKLRD 705; Cheung Chui SouYing v The Personal Representatives of Cheung YukLuen alias Wilson Cheung Deceased and Ors [1981] HKLR 585. Future property is not assignable at law, but can be assigned in equity for valuable consideration. Such assignment operates as an agreement to assign the property: Glegg v Bromley, Glegg v Anor [1912] 3 KB 474 (CA); European Asian Bank v Wo Ping Ching & Ors [1986] HKLR 1198 (HC). Future property is distinguished from a contingent interest in existing property. It includes a mere expectancy and a spes successionis (hope of succession).
