| 释义 | 轉換律師 The engagement of a new solicitor. A party to litigation may at any time change solicitor. When there has been a change of solicitor since the judgement the new solicitor must put his name on the record by serving notice of change before issuing execution. The solicitor on the record is considered to be the party’s solicitor until the final conclusion of the cause or matter: The Rules of the High Court (Cap 4A) O 67 r 1. An action is treated as not concluded until execution has been issued: Manley Estates Ltd v Benedek [1941] 1 All ER 248 (CA). 聘用新的律師。訴訟一方當事人可隨時轉換律師。倘判決書頒下後轉換律師，則新聘用律師在發出判決令執行前，必須先送達轉換律師通知書將姓名紀錄。已紀錄的律師會被視為該當事人的律師，直至訟案或事項最終結束為止：《高等法院規則》（第4A章）第67號命令第1條。訴訟案在判決執行令未發出前得視為仍未終結：Manley Estates Ltd v Benedek [1941] 1 All ER 248（英國上訴法院）。 |
