释义 | 移審令 Lat – to be informed. A type of prerogative remedy issued by a court to bring before it the decision or determination of a tribunal or inferior court to quash it on the ground of non-jurisdictional error of law on the face of the record, or for jurisdictional error or denial of procedural fairness. It is available once the tribunal has completely determined the matter (being then functus officio). An order of certiorari is a matter of discretion: Cheung Ernest v Christie (Permanent Magistrate) [1983] 2 HKC 562. Orders of certiorari are inappropriate in relation to the search warrants, charges and consent of an Attorney General for proceedings, so they are not subject to judicial review upon authority: Egan v Cmr of the Independent Commission Against Corruption [1991] 1 HKC 119.
