释义 | 在沒有通知的情況下付出價值的真誠購買人的原則 The common law rule that where legal title is conveyed to a purchaser who has no notice of any prior equitable interest, that purchaser takes free from any such equitable interest. This is known as cardinal principles which stated as maxim: Legal rights are good against all the world; equitable rights are good against all persons except a bona fide purchaser of a legal estate for value without notice, and those claiming under a purchaser. This principle is also used to determine the priority of an equitable interest. Those three additional qualifications must be met by the interest-holder to obtain this priority in registration, namely, he must be bona fide; he must give valuable consideration; and he must be a purchaser or mortgage: Land Registration Ordinance (Cap 128) s 3(2).
