释义 | 侵擾、闖入 A wrongful interference with, or entry into possession of, the property or other rights of another person. Real property - See Trespass to land. Tort - An interference with the right of an occupier to exclusive enjoyment of his or her property: Thomsen & Anor v Johnson Burglar Alarms Co Ltd [2001] 4 HKC 666; Lo Yu Chu v Kam Fu Lai Development Co Ltd [1994] 3 HKC 18 (CA). An intrusion into airspace is an interference with the plaintiff’s right to enjoyment of the land underneath and may therefore constitute a trespass to land. Although not all intrusions into airspace are trespasses, an intrusion caused by a fixed structure such as overhanging trees, advertising signs or cranes, or for unauthorised laying of electric or telephone or other cables or for the overlapping of a wall is trespass: Halsbury’s Laws of Hong Kong, Vol 25, Tort [380.376]. Where there is no act of direct intrusion on another person’s property, liability in trespass does not arise, although liability may arise in nuisance: Lemmon v Webb [1894] 3 Ch 1 (CA).
