释义	明訂的條件 An essential term stated in the contract. Breach of an express condition gives rise to a cause of action for claim for damages. An express condition can be waived by the parties to the contract: Yeu Shing Construction Co Ltd v Pioneer Concrete (HK) Ltd [1987] 2 HKC 187 (CA). In case of conflict arising between an express condition of a contract and a statutory provision, the latter would prevail: Pearl Island Hotel Ltd v Li Ka Yu & Anor [1988] HKC 512 (HC). For example, in the law of sale of goods, an express condition does not negative a condition implied by the Sale of Goods Ordinance unless inconsistent with it: Sale of Goods Ordinance (Cap 26) s 57(2).
