A disciplinary sanction by which a student is forbidden to continue to attend an educational institution. It is unclear whether a school principal must observe the rules of natural justice when deciding whether or not to expel a student: Fitzgerald v Northcote (1865) 4 F & F 656, 176 ER 734. In Hong Kong, if in the opinion of the Director of Education the behaviour of any pupil is undesirable or improper or contrary to the good of the school or the other pupils, he may, in his absolute discretion, require the supervisor and principal to expel such pupil from the school or to suspend him for such time and under such conditions as the Director may specify: Education Regulations (Cap 279A) reg 96(1). This does not prejudice the right of a principal or supervisor to expel or suspend a pupil from the school: reg 96(2). No pupil who has been expelled from a school is permitted to enter or remain in the school premises without the permission of the Director: reg 97(1).
