| 释义 | 自付額條款 This is an insurance provision which provides that the insured is to bear any individual loss up to a specified figure, leaving the insurers with liability only for any excess over that figure: Re Law Guarantee Trust and Accident Society Ltd Liverpool Mortgage Insurance Co Ltd’s case [1914] 2 Ch 617 (CA). The specified figure (which may either be a sum or a percentage) is called the ‘excess’ or ‘deductible’. If the excess clause applies to ‘each and every loss or occurrence’ and none of the individual losses are greater than the excess, the insured will not recover anything even though the total loss is greater than the excess: Philadelphia National Bank v Price [1938] 2 All ER 199 (CA).
