释义 | 不適合居住 Leased premises where the state of repair ‘is such that by ordinary user damage may naturally be caused to occupier, either in respect of personal injury to life or limb or injury to health’: Morgan v Liverpool Corp [1927] 2 KB 131. On the letting of a furnished house, there is an implied condition that it is in a fit state for habitation at the commencement of the tenancy; and, if this condition is not fulfilled, the tenant is entitled to repudiate the contract at once: Wilson v Finch-Hatton (1877) 2 Ex D 336. The implied condition may be treated also as a warranty, and the tenant may recover damages for the breach: Collins v Hopkins [1923] 2 KB 617.
