In relation to land title an instrument purporting to deal with the entire legal and equitable estate in the property sold, and containing nothing to throw any suspicion on the title of the disposing parties: Re Cox and Neve’s Contract [1891] 2 Ch 109; Halsbury’s Laws of England, Vol 42 (Reissue), Sale of Land para [142]. In Hong Kong, Government lease is the ultimate root of title. Where a Government lease is less than 15 years old, it constitutes the sole root document. However, where a Government lease is more than 15 years old, the vendor must also produce the intermediate root document, which must either be an assignment, mortgage by assignment or a legal charge, each dealing with the whole estate and interest in land and must extend not less than 15 years before the present contract for sale of the land: Conveyancing and Property Ordinance(Cap 219) s 13; Sihombing & Wilkinson, A Student’s to Hong Kong Conveyancing (1997), ch 6, pp 324-7.
