释义 | 不可就損耗而受指責 Not liable at common law to the remainderman for reducing the value of land. Under common law rules of waste, a life tenant in possession of land is liable to the remainderman for committing voluntary waste to the land; the remainderman’s remedy is damages or an injunction, or both: for example High Court Ordinance (Cap 4) s 21L(4). If, however, the instrument granting the life estate renders the life tenant unimpeachable for waste, the life tenant may commit waste on the land with impunity. Nevertheless, even where the instrument makes the life tenant unimpeachable for waste, he or she is not protected from the doctrine of equitable waste: Nield, Hong Kong Land Law (2nd Ed) ch 11 p 287.
