| 释义 | 無保險的司機 A driver of a motor vehicle in respect of whose actions there is no policy of insurance in force. Failure to comply with the requirements as to compulsory third party insurance is an offence: Motor Vehicles Insurance (Third Party Risks) Ordinance (Cap 272) s 4(2)(a). The victim of an uninsured driver also has rights under the agreement made between the Motor Insurers’ Bureau and the Hong Kong Government by which the bureau has agreed to satisfy any unsatisfied judgment arising from any liability required by the Motor Vehicles Insurance (Third Party Risks) Ordinance to be covered by a policy of insurance and to compensate victims of untraced drivers. Failure to perform this statutory duty to insure will involve a civil liability to a person injured by the uninsured vehicle: Corfield v Groves [1950] 1 All ER 488. 就其作為而言，沒有有效的保單的汔車司機。如未能遵從強制性第三者保險的規定，即屬犯罪：《汽車保險（第三者風險）條例》（第272章）第4(2)(a)條。根據香港汽車保險局與香港政府之間訂立的協議，無保險司機的受害者亦有權利，透過該協議香港汽車保險局同意履行任何因《汽車保險（第三者風險）條例》規定的法律責任而產生的未獲履行的判決，藉保單該法律責任受保，及補償及補償未找到蹤跡的肇事司機的受害者。如未能履行此等投保的法定責任，則對被無保險的汽車傷害的人牽涉民事法律責任：Corfield v Groves [1950] 1 All ER 488。 |
