释义 | 偏航原則 A rule applied to bailment contracts and contracts for carriage by sea, land and rail. The carrier is required to follow the agreed route or, if none is specified, an usual and reasonable route, without unjustifiable deviation. The deviation on the part of the carrier may disentitle him to rely on exemption clause: Joseph Thorley Ltd v Orchis Steamship Co Ltd [1907] 1 KB 660 (CA); James Morrison & Co Ltd v Shaw, Savill & Albion Co Ltd [1916] 2 KB 783; Stag Line Ltd v Foscolo, Mango & Co Ltd [1932] AC 328 (HL); Hain Steamship Co Ltd v Tate & Lyle Ltd [1936] 2 All ER 597 (HL).
