释义 | 逃脫/逸出/外溢/逸漏危險物品 The escape or collection of any substance dangerous in itself, or a source of danger, from land where the occupier brought the substance onto the land originally: Rylands v Fletcher (1868) LR 3 HL 330. The rule in Rylands v Fletcher applies only to things likely to do mischief if they escape: Halsbury’s Laws of Hong Kong, Vol 25, Tort, [380.238]. In the absence of negligence the landlord is not in general liable for the escape of dangerous things from the landlord’s part of the premises, as the tenant takes the property as he finds it and impliedly consents to their presence on the landlord’s premises; but the tenant’s consent cannot be implied to an unusual danger unless he knows of it: Halsbury’s Laws of Hong Kong, Vol 17, Landlord and Tenant [235.329].
