释义 | 共同權利 A right exercised in common with others to take the natural produce from the land or water belonging to another. However, not all rights in common can be exclusive or right in severalty. Almost all rights of common are profits à prendre, but all profits à prendre are not necessarily rights of common. The right to take a particular substance from another man’s land may in one case be a right in severalty, and in another a right of common: Fitzpatrick v Verschoyle [1912] 1 IR 8. Rights of common are often classified into four categories according to subject matter: right of pasturage, right of fishery (‘piscary’), right of turbary, and right of estover. Also known as ‘profit à pendre’.
