释义 | 進入權 The right to take possession of land by entering upon the land in a peaceful manner. A right of entry may be an original right arising because a person has been dispossessed of the land or an estate has determined. A right of entry may also arise where the right is reserved in a lease for a breach of a covenant or where an order allowing recovery of possession has been made by a court: for example Shing Yip Co Ltd v Lai Choi-wan [1979] HKDCLR 9. The right also extends to person entering into another person’s land in order to comply with statutory requirements, for example, to carry out repairs: Landlord and Tenant (Consolidation) Ordinance (Cap 7) s 24. In the case of weekly tenancies, where neither the landlord nor the tenant is expressly bound, a reservation by the landlord of a right to enter to carry out repairs is a term which the court will readily imply: McAuley v Bristol City Council [1992] QB 134, 1 All ER 749 (CA).
