1. A person who commits the offence of spying, ie for a purpose prejudicial to the safety or interests of the People’s Republic of China or Hong Kong he: (1) approaches, inspects, passes over or is in the neighbourhood of, or enters, a prohibited place; (2) makes a sketch, plan, model or note that is calculated to be or might be or is intended to be directly or indirectly useful to an enemy; or (3) obtains, collects, records or publishes, or communicates to any other person, any secret official code word or password, or any sketch, plan, model or note, or other document or information, that is likely to be or might be or is intended to be directly or indirectly useful to an enemy: Official Secrets Ordinance (Cap 521) s 3(1). 2. Any member of an armed force that is engaged in espionage while not in uniform. A police spy or an agent provocateur is not regarded as accomplice in a crime: Sneddon v Stevenson [1967] 2 All ER 1277, 1 WLR 1051 (DC). A spy does not have to be treated as a prisoner of war if captured: 1977 Geneva Protocol 1 Additional to the Geneva Convention 1949 art 46. See also Espionage; Prisoner of war.
