释义 | 管有權的共有 1. In relation to the law of easements, a situation where the servient and dominant tenements are in the possession of one person. If both possession and ownership of the dominant and servient tenements are in one person, the easement is extinguished (unless preserved by statute). 2. In relation to co-ownership, one of the ‘four unities’, which are the indicia of a joint tenancy. No co-owner is entitled to the possession of any particular part of the land to the exclusion of his fellow co-owner: Nield, Hong Kong Land Law (2nd Ed) ch 10 p 231. Unity of possession also exists in a tenancy in common, where the occupation is undivided, and neither owner can claim separate part save by obtaining partition, or in the case of a multi-storey building a right of exclusive possession or occupation: Halsbury’s Laws of Hong Kong, Vol 16, 2001 Reissue, Land [230.0813]; Wing Ming Garment Factory Ltd v Incorporated Owners of Wing Ming Industrial Centre & Anor [1994] 2 HKC 748.
