The test whether a remedy is cumulative is where both remedies claimed are based on claims for a wrong and each wrong is different from the other, and the two remedies must not overlap resulting in excessive damages: Sutherland Publishing Co Ltd v Caxton Publishing Co Ltd [1936] Ch 323.
