The rights which pass to a bailee under a bailment, entitling the bailee to exercise certain possessory remedies: Clough Mill Ltd v Martin [1984] 3 All ER 982, [1985] 1 WLR 111 (CA). In particular, a pledgee or pawnee has the right to hold the goods as security until the outstanding debt is repaid or obligation performed: Donald v Suckling (1866) LR 1 QB 585. However, if performance of the obligation is offered and wrongfully refused, the pledgee or pawnee loses his or her special property and has no rights in the chattels: Bank of New South Wales v O’Connor (1889) 14 App Cas 273. Special property also includes the right to sub-pledge unless excluded by agreement. See also General property; Pawn.
