One who occupies land or a building without the consent of the rightful owner and without paying rent; in effect a trespasser. See also Adverse possession.
Tort - A person occupying land without legal title or authority. In order to constitute adverse possession, the acts of the squatter must not only be of a sufficient length of time, they must also be of a particular quality. There must be continuous possession adverse to that of the true owner by a squatter (Hayward v Challoner [1967] 3 All ER 122) who had animus possidendi to exclude all others from the land, including the true owner (Man Kam-tong v Man Lin-tai [1984] HKLR 181, [1985] 2 HKC 299). Intention is a matter of fact: Ho Har Wan v Ma Ting Cheung [1990] 1 HKLR 649. In Hong Kong, included in the category of rights and encumbrances of renewed Government leases are the rights of squatters who have acquired a possessory title by adverse possession before 1 July 1973: Lai Moon Hung v Lam Island Development Co Ltd [1995] 2 HKLR 228, [1994] 2 HKC 11 (CA). A squatter may be entitled to acquire an easement over other land by way of prescription: Chung Yeung Hung v Law Man Nga and Wong Siu Lan (t/a Constant Rich Investment Co) [1997] HKLRD 1022, 2 HKC 406 (CA).
