释义 | 分租租契 A lease of a leasehold interest (known as the headlease). It includes an agreement for an underlease where the underlessee has become entitled to have his underlease granted: Conveyancing and Property Ordinance (Cap 219) s 58(5)(d). A sublease may be in respect of the whole or part only of the premises, and must terminate before the termination date of the headlease, or it will in fact be an assignment of the headlease. Any sublease granted after the termination of the original tenancy will be of no effect: Pun Wong Yin Yuk v VN Dounaeff [1958] HKLR 66 (CA). In the absence of any restriction of his right, a tenant may sublet it for any period less than the residue of his own term. A sublease by deed for a term equal to or greater than the residue of the tenant’s own term operates as an assignment of his term, and not as an sublease: Chan Yeung Kei v Chan Yeung Fai [1998] 2 HKC 491. The sublease must not conflict with the terms of the headlease. Also known as ‘underlease’.
