释义 | 撤銷控罪指引 In criminal law, a direction which may be given by a trial judge to the jury at the close of the case for the prosecution, in such direction the trial judge indicates to the jury that the charge may be dismissed at any time after the close of the prosecution case notwithstanding there is a case to answer if that tribunal thinks that the evidence is of such little weight that it would not be safe for any reasonable tribunal to convict upon it: Prasad v R [1981] 1 All ER 319, 72 Cr App Rep 218 (PC); A-G v Kwan Ngan Chung [1981] HKC 439. In other words, evidence which was received at the trial within a trial on the issue of admissibility may be relevant to the question of the weight to be given to the confession, and may be put to the jury for that purpose: Prasad v R, supra. Where a judge proposes to adopt this course he should afford the prosecution an opportunity to be heard on the topic: A-G’s Reference (No 2 of 1986) [1987] HKLR 1104 (CA).
