| 释义 | 推翻 The setting aside or annulment of a decision of a lower court by a higher court to which an appeal was brought. A reversal of the original decision means that the appellate court considers the case to have been wrongly decided, the appellant wins the case and the appellate court either substitutes its own judgment or returns the case to the lower court with instructions on how to proceed. The Court of Appeal considers the materials which were before the judge below, and the additional materials, if any, before the court itself, and then makes up its own mind, carefully weighing and considering the judgment appealed against, and reversing it if, on full consideration, it comes to the conclusion that the judgment was wrong: Manciple Ltd v Char On Man [1995] 3 HKC 459 (CA). 在審理有關的上訴案件時，由上級法庭撤銷或廢止下級法庭作出的決定。推翻原本的決定表示審理上訴的法庭認為有關案件之前的決定不當，上訴人會勝訴，而審理上訴的法庭會以自己的判決取代或連同處理的指示交還案件予下級法庭審理。上訴法庭會慮考慮之前在法官之下的資料，而如有任何附加的資料，則在上訴法庭本身前面考慮，然後作出決定，小心衡量及考慮在上訴所針對的判決，如在作出全面考慮後，結論是有關的的判決不當，便會推翻有關的判決：Manciple Ltd v Char On Man [1995] 3 HKC 459 （上訴法庭）。n. |
