| 释义 | 終止留置權 The ending of a lien or right of retention. Depending on the context it may mean the ending of the lien other than, as is usually the case, the discharge of the lien by repayment of the debt or performance of the obligation that the lien secured. For example, when the seller delivers the goods to a carrier or other bailee for the purpose of transmission to the buyer without reserving the right of disposal of the goods (Sale of Goods Ordinance (Cap 26) s 45(1)(a)); or when the buyer or his agent lawfully obtains possession of the goods (s 45(1)(b)); or by waiver of the lien or right of retention (s 45(1)(c)). Where at the time of the contract the goods are in the possession of the seller’s agent, the lien is lost where the agent, with the seller’s consent, acknowledges to the buyer that he holds the goods on his behalf: Re McLaren, ex p Cooper (1879) 11 Ch D 68 (CA). Where at the time of the contract the goods are in the possession of a third person, not being the seller’s agent, the lien is lost where the seller puts the goods at the disposal of the buyer, who is able, without interference by that third person, to take actual or constructive possession of the goods: Marshall v Green (1875) 1 CPD 35. Where at the time of the contract the goods are in the possession of the buyer himself as the seller’s bailee, the lien is lost where the contract of sale is complete: Cain v Moon [1896] 2 QB 283 (DC).
