释义	報應的損害賠償 A form of damages awarded for the purposes of retribution. An award of retributive damages exceeds the amount of damages necessary to compensate the claimant for loss suffered. Thus, retributive damages are not compensatory in nature; instead, they are awarded against the wrongdoer not only for the wrong done but also to punish the wrongdoer where the tort is characterised by malice, and to deter other: for example Cassell & Co Ltd v Broome [1972] AC 1027, 1 All ER 801. Retributive damages are not awarded at common law merely for wilfully wrong acts, and the damages must not be excessive or unreasonable. It may only be awarded in a limited category of cases: More commonly known as ‘punitive damages’ or exemplary damages’.
