| 释义 | Hicklin驗証 A test of obscenity, formulated in R v Hicklin (1868) LR 3 QB 360. The test requires the court to consider ‘whether the tendency of the matter charged as obscenity is to deprave and corrupt those whose minds are open to such immoral influences, and into whose hands a publication of this sort may fall’. The Hicklin test is applicable to the common law offence of obscene libel and has no bearing on the definition of obscenity under the Control of Obscene and Indecent Articles Ordinance (Cap 390), which reduces the question to one of suitability of publication to all persons.
