| 释义 | 重審 A rehearing of a matter for which there has already been a previous trial. Following a successful appeal, a retrial may be ordered if this is in the interest of justice: Criminal Procedure Ordinance (Cap 221) s 83E(1). The relevant considerations include: (i) the seriousness of the offence, the history of the proceedings, the evidence for both prosecution and defence, the complexity or otherwise of the trial, the reasons for success of the appeal, the lapse of time since the alleged offence and since the trial, the length of sentence which the appellant may have served: R v Holgate (No 2) [1996] 3 HKC 324. A retrial should not be ordered if there is no prospect for a conviction: R v Holgate (No 2), supra. The Court may grant a second re-trial: R v Lam Ming Kwong [1984] HKC 237 (CA). An order for re-trial would not be an abuse of the process of the court: R v Wong Chung-ling [1995] 3 HKC 82, 2 HKCLR 179. The court is not bound to impose the same punishment upon the defendant if he is convicted in the retrial: R v Chan Chung Chiu [1987] 3 HKC 144. Where a re-trial is ordered, the accused must be tried on a fresh indictment: s 83F(1). On a re-trial there are some changes to the rules of evidence. Depositions ordinarily admissible in criminal proceedings of persons who gave evidence at the original trial or written statements tendered at committal proceedings are not admissible: sch 6 para 1.
